Our dynamic LLM in International Commercial Dispute Resolution course invites you to explore how the law can assist and facilitate the resolution of international or cross-border commercial disputes and thus world trade.
With the significant rise in international trade and business over the past few decades, there has been a corresponding increase in complex cross-border commercial disputes, requiring specialised management and resolution techniques distinct from purely domestic disputes. Most leading international law firms have dedicated departments for international dispute resolution, making this course essential for those aspiring to a career in cross-border dispute resolution, international trade and commerce, or trade-related government roles.
Housed in the historic Earlham Hall, at UEA Law School you will learn to think from an international legal perspective and will gain comparative knowledge of various approaches to international commercial dispute resolution. In addition to studying international commercial litigation and international commercial arbitrations, you can select optional modules, such as investment law and arbitration, Sharia Arbitration, and international construction law and dispute resolution. There is also an option to study a 40-credit module and then participate in the world-famous Willem C Vis International Commercial Moot Module (subject to the Organiser’s admission criteria for mooters). See Vismoot for more details.
You will start your course by taking the compulsory non-credit bearing Postgraduate Legal Skills and Research module. You will discover the essentials of international commercial dispute resolution.
You will be provided with an introduction to the issues which arise in the litigation of commercial disputes on an international basis, addressing the treatment of jurisdiction and applicable law in commercial disputes with reference mainly to UK and European legal sources.
You will also be introduced to the theory and practice of international commercial arbitration., allowing you to understand the nature and operation of the arbitral process in the context of international commercial relationships as a means of resolving disputes that arise in those relationships
You will then have the chance to explore some specialist areas of international commercial dispute resolution law such as, international investment and arbitration law, and international construction law and dispute resolution.
You will write a dissertation on an area of specific interest to you, falling broadly within the field of international commercial dispute resolution.
